Dale Charles' Commercial Photography              License, Terms & Conditions            Jan 1, 2024

I've photographed around 2000 projects in 17 years, most of them mid to high-end architecture. Fine homes, Vineyards, major estates, galleries, studios, apartments, lofts, Airbnb listings, condos, standard homes, office spaces,  and so on.

Here's a recent high-end handbag product shoot https://theflie.com/collections/shop

PHILOSOPHY: Photography is an art form and I treat it as such.

Please schedule your shoot as far in advance as possible, preferably at least five days before needed. In the busy months my workload can be heavy, especially for large jobs which take days to develop in post. I need a half to full 8 hr day on site for smaller jobs, longer for significant projects. I love what I do and take my time to get it right.

MY WORKFLOW: Similar to the world's best architectural and interior design photographers who charge four to five figures for a dozen images. (Those structures are so well designed, with an intense focus on capturing natural sunlight, you can get incredible images of them from a cheap pocket camera). I use highest-quality lenses and off-camera lighting to supplement an interiors' natural light. I carefully develop each image in lengthy post-production sessions to achieve the best possible results ensuring white balance is correct, exposure is optimal, colors are accurate, perspective is plumb and level, shadows, highlight and mid-tones are balanced and that each image is believable

FEES: Your payment to me is a License Fee to use Digital Copies of my Original Work. Copyright is always owned by The Photographer in any industry. Copyright does not transfer to a client or end-user, only a digital copy of The Photographer's Original Image does.

USAGE: To advertise, market and or promote a business or service or as stated in the contract.

TERM: As defined in our contract. Per issue, monthly, yearly etc., as well as Lifetime Usage Terms can be negotiated.

TRANSFER: Digital Copies of The Photographers Original Work are non-transferable as a gift or resale to any for-profit, third-party for their Business Use. You may not “give” or “resell” copies of my My Work to any for-profit third-party, they must contract with and pay me a License fee for *their* new usage.

When a third-party wants to use my work in their business. Most commercial work is specific to and used only by the client. Unless or stated in our contract I reserve the right to License digital copies of my original work for profit as is standard photographic practice. I do not charge higher rates if our business is your single-use only.

For example, an architect, builder, sub-contractor and or manufacturer sees my work on your website, social media or marketing and want to use a number of my images to advertise with. They are third-parties. The client (you) not have the right or license to sell or give third-parties Copies of My Original Work for their Business Use. The new client(s), a third-party, must each License directly from me, paying me for the new usage. In this instance, there are four parties and four separate uses, therefore, four Licenses and four payments. Architect, builder, sub, manufacturer. This is how professional photographers earn a living and have conducted business for 100 years.

Example: If I license an image to Newsweek, they cannot sell it to Time Magazine, Time has to license it from me and pay my standard fee.

I reserve the Right to use My Work in my portfolio and social media accounts unless specified within our contract.

PAYMENT: One-third or 33% non-refundable deposit is required and payable before I start the location shoot. The balance is due upon receipt of photos.

I do not charge for scouting and meetings.

Pay by check to Dale Charles, use debit and credit cards online via PayPal using my prints@compago.net PayPal ID. I prefer and accept Venmo, my ID is @tarrymore

I also accept Bitcoin.

COPYRIGHT & LEGALPhotographers own Copyright which does not transfer to clients when images are Licensed and delivered. Clients pay for and own a temporary License to use Digital Copies of a photographer’s Original Work, another standard professional photography practice for over 100 years.
