Licensing

Content from the Marilyn Nance Archive must be licensed before use. You are not purchasing the image itself, just a license to use the image. You are not allowed to edit or alter images unless authorized. The license granted to you is non-transferable: work produced incorporating the image must be for your own use or for the use of your direct employer, client or customer, who must be the end user of your work. Re-selling or re-licensing is not permitted.

Permission to publish, reprint, broadcast, or make any reproductions made from original archival material may be granted subject to the following conditions:

• The publication use fee and all reproduction costs must be paid in advance. Contact the archive regarding fees.
• Permission is granted for ONE TIME USE ONLY.
• The Marilyn Nance archive shall determine when, where, and how reproductions are to be made. If permission is granted for the requesting party itself to photograph material, all negatives and digitized files must be given to TheMarilyn Nance Archive. It is understood and acknowledged that the negatives and digitized versions of images shall become the exclusive property of The Marilyn Nance Archive which shall own all right, title and interest in and to such negatives and digitizations which may not be further used by the publisher/user without written license obtained from The Marilyn Nance Archive.
• The publisher/user shall send to The Marilyn Nance Archive two copies of the work (or a copy of the title frame and the frames showing the image used, and the frame showing the picture credits in the case of a motion picture or video-tape or multimedia production), in which the item is reproduced.
• The prospective user and their publisher have the sole responsibility for observing literary property rights, persona; property rights, libel, unwarranted invasions of privacy and any infringement of the U.S. Copyright Code.
• Proper acknowledgement must be given to the Marilyn Nance Archive for each item used, as follows (after identification of the item): © Marilyn Nance, Courtesy of the Marilyn Nance Archive.
